Capescapes Tour Operator and his brands Terms & Conditions

1. Agreement

These Terms & Conditions constitute an agreement (the “Agreement”) between you (the “Customer”) and Capescapes Tour Operator (“Capescapes,” “we,” or “us”). By booking a tour or using our services, you agree to be bound by these Terms & Conditions. Please read these terms carefully.

2. Booking & Payment

a. Reservation: To book a tour, you must make a reservation through ours websites, or via phone. We require a non-refundable deposit upon booking, which will be deducted from the total tour price.

b. Payment: The remaining balance is due one work day before the tour date. Payment can be made by credit card, bank transfer, or other methods as specified by Capescapes.

c. Cancellations: Cancellations may result in the forfeiture of your deposit or other fees as specified in our cancellation policy. Please review our cancellation policy for specific details.

3. Tour Details

a. Itinerary: We will provide you with an itinerary for your tour. However, we reserve the right to make necessary changes to the itinerary due to unforeseen circumstances, including but not limited to weather, road conditions, and safety concerns.

b. Tour Inclusions: The tour price includes all items listed in the itinerary. Any additional expenses, such as meals not specified, personal purchases, and optional activities, are the responsibility of the Customer.

4. Health & Safety

a. Medical Conditions: Customers must inform us of any medical conditions, disabilities, or special dietary requirements when booking. We will make reasonable efforts to accommodate such requests.

b. Travel Insurance: We strongly recommend that you purchase travel insurance to cover unexpected events, such as trip cancellations, medical emergencies, or lost luggage.

5. Liability

a. Assumption of Risk: Participation in our tours involves inherent risks. Capescapes is not responsible for any injury, loss, damage, or delay caused by third parties, natural disasters, accidents, or other events beyond our control.

b. Limitation of Liability: In no event shall Capescapes be liable for any indirect, special, or consequential damages, including but not limited to loss of income or profits.

6. Privacy

a. Data Collection: We collect and store personal information as required for booking and providing our services. Please refer to our Privacy Policy for details on data usage and protection.

7. Termination

Capescapes reserves the right to terminate services to any Customer who fails to comply with these Terms & Conditions or engages in disruptive or dangerous behavior during the tour.

8. Governing Law

This Agreement is governed by the laws of Cape Verde. Any disputes arising from this Agreement shall be resolved in the courts of Comarca da Praia.

9. Changes to Terms

Capescapes reserves the right to amend these Terms & Conditions at any time. Customers will be notified of any changes, and the revised terms will apply to future bookings.

By booking a tour with Capescapes or any of Capescapes Brands like, you acknowledge that you have read, understood, and agreed to these Terms & Conditions.
